License Agreement

Read this Software Agreement ("License") carefully before pressing the "I agree" button. By pressing "I agree", you and your employer and any entity with which you may be affiliated (collectively, "You" or "Your") are agreeing to be bound by the terms of this License. If you do not agree with the term of this License, press "Cancel".
1. General.

The software and documentation The Easy Bee accompanying this License whether on disk, in read-only memory, on any other media or in any other form (collectively the "Software") are licensed, not sold, to You by Altercept for use only under the terms of this License, and Altercept reserves all rights not expressly granted to You. The rights granted herein are limited to Altercept intellectual property rights in the Software and do not include any other patents or intellectual property rights. You own the media on which the Software is recorded but Altercept and/or Altercept licensor(s) retain ownership of the Software itself.

2. Non-Profit Customer definition and restriction

Non-Profit Customer is defined as a customer who uses The Easy Bee in non-commercial environment for non-profit activity.
All users who use The Easy Bee in a business, government, military, or religious institution are not Non-Profit Users. Users in universities and high schools are classified as non-profit users even if a school or university is owned and operated by a government.
Only Non-Profit users are allowed to use The Easy Bee for free. Other users are allowed to try The Easy Bee for free during 30 days. If You are not a Non-Profit user and if you need to use The Easy Bee during more than 30 days, You must buy the Standard Edition license of The Easy Bee.
3. Permitted License Uses

A. This License allows You to install and use one copy of the Software on a single computer at a time, which can be used only by one individual. This restriction applies to all versions of The Easy Bee.

B. Except as and only to the extent expressly permitted in this License or by applicable law, You may not copy, decompile, reverse engineer, disassemble, modify, or otherwise attempt to discover the source code, underlying ideas, or algorithms of the Software or any subsequent version thereof or any part thereof, or create derivative works of the Software or any part thereof. THE SOFTWARE IS NOT INTENDED FOR USE IN THE OPERATION OF NUCLEAR FACILITIES, AIRCRAFT NAVIGATION OR COMMUNICATION SYSTEMS, AIR TRAFFIC CONTROL SYSTEMS, LIFE SUPPORT MACHINES OR OTHER EQUIPMENT IN WHICH THE FAILURE OF THE SOFTWARE COULD LEAD TO DEATH, PERSONAL INJURY, OR SEVERE PHYSICAL OR ENVIRONMENTAL DAMAGE.

C. Nothing in this Agreement grants You, Your distributors, and/or any person(s) acting with or for You any rights, license, or interest with respect to the source code, HTML files, htc files, or any other clear text files of the Software.

D. Nothing in this Agreement grants You, Your distributors, and/or any person(s) acting with or for You the right to receive any upgrades, modifications or other enhancements to Software at any time.

E. Nothing in this Agreement grants You, Your distributors, and/or any person(s) acting with or for You the right to sell or freely distribute any software or service based on the Software.

4. Transfer.

You may not rent, lease, lend, redistribute or sublicense the Software.

5. Ownership/Proprietary Rights

A. Your rights in and to the Software are solely as set forth in Section 3, and do not include any rights of ownership. You agree that Altercept or its suppliers owns all right, title, and interest (including, but not limited to, ideas, know-how, copyright, patent, trade secret and other intellectual property rights) to the Software, including any and all modifications, enhancements, derivative works, and other alterations by any person or entity. B. The structure, organization and code embodied in the Software are the valuable and confidential trade secrets of Altercept and are protected by intellectual property laws and treaties. You agree to take all reasonable measures to protect Altercepts intellectual property rights and to abide by all applicable laws. C. You agree not to remove, alter, or destroy any proprietary, trademark, or copyright markings or notices placed upon or contained within the Software or any related materials. D. Altercept reserves the right to modify or discontinue the Software at any time without prior notice to or consent by You.
6.Disclaimer of Warranties

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE SOFTWARE IS AT YOUR SOLE RISK AND THAT THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY AND EFFORT IS WITH YOU. EXCEPT FOR THE LIMITED WARRANTY ON MEDIA SET FORTH ABOVE AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE IS PROVIDED "AS IS", WITH ALL DEFECTS AND WITHOUT WARRANTY OF ANY KIND, AND ALTERCEPT AND ALTERCEPT LICENSORS (COLLECTIVELY REFERRED TO AS " ALTERCEPT ") HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE SOFTWARE, EITHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT, AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS. ALTERCEPT DOES NOT WARRANT AGAINST INTERFERENCE WITH YOUR ENJOYMENT OF THE SOFTWARE, THAT THE FUNCTIONS CONTAINED IN THE SOFTWARE WILL MEET YOUR REQUIREMENTS, THAT THE OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS IN THE SOFTWARE WILL BE CORRECTED. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY ALTERCEPT OR AN ALTERCEPT AUTHORIZED REPRESENTATIVE SHALL CREATE A WARRANTY. SHOULD THE SOFTWARE PROVE DEFECTIVE, YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, OR CORRECTION. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON APPLICABLE STATUTORY RIGHTS OF A CONSUMER, SO THE ABOVE EXCLUSION AND LIMITATIONS MAY NOT APPLY TO YOU.

7. Limitation of Liability.

TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL ALTERCEPT BE LIABLE FOR PERSONAL INJURY, OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE SOFTWARE, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT OR OTHERWISE) AND EVEN IF ALTERCEPT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY FOR PERSONAL INJURY, OR OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION MAY NOT APPLY TO YOU.

EACH PARTY ACKNOWLEDGES THAT IT HAS READ THIS AGREEMENT, UNDERSTANDS IT, AND AGREES TO BE BOUND BY ITS TERMS.

8. Privacy Policy

Personal data
All data that you enter into The Easy Bee and that needs to be stored for later use is stored locally on your computer. It is neither stored in any external server nor sent to any external server.
In other words, The Easy Bee is NOT a spyware.

Monitoring
The Easy Bee does not send information about sites that you visit or any information about your browsing or any other information to any servers.
In other words, The Easy Bee is NOT a spyware.

Auto update
When launched The Easy Bee checks The Easy Bee web site www.TheEasyBee.com for updates. If it finds a version that is newer than the version currently installed on Your system, The Easy Bee will offer You to download and install the newer version.
The data sent to www.TheEasyBee.com during this process is the current version and the current date and time.
No personal data is transmitted in this process.
